Later in battle, no, there is no order or priority. Either side can play cards, and the other side can play cards to respond if they want. (This is a ruling from Corey).

I haven't seen it be an issue in my games, although if both players were just trying to outwait each other, you could probably just incorporate a "going once, going twice, done" type thing.

I think the reason it hasn't been an issue for us is that really, the loser would be the one more inclined to play a card. The winner won't need to play one if they are already winning. In fact, right off the top of my head, I can't really think of a situation where the winner would want to play a card first. So if the loser declines, then you can probably just stop there.

I think the ruling given emphasizes that if the loser plays a card, the other player could respond by playing a card, then the first player could respond to the response, etc. I think this difference in "priority" is because prior to the battle was to not penalize the attacker too much for "winning" - letting them respond to cards that may tip the scales helps prevent turtling, even if to a small degree.
