I would agree - there is no battle, so there is no "winning" the battle. The Tactical Retreat rules simulate the retreat portion of a battle, but previous rulings have emphasized that there is no "check strength" step, and that if a Commander was in the area, it does not retreat with the units since it only does so if there is a battle there.

I would say that mechanically, Pillage cannot be used when the opponent plays Tactical Retreat. (Thematically, this makes sense to me, too, because it means they aren't routing, but are retreating on their own terms, which means they could have done whatever preparations would be necessary to prevent the land from being pillaged to their detriment).
